Well, I made that argument with the dealer, rather strongly, but we got into the discussion of "general maintence and general performance of the vehicle would benifit from a tranny flush and fill". You're points are correct though.
Why should I be asked to flush and fill the tranny on a car under warranty to fix a definate problem, when the required interval for replacement is 52k, and only when towing!?
Sling, the answer is that they "believe me" but it feels ok to them. So, no they haven't properly acknowledged the problem yet. They're going to need to spend some time driving this car to get the sense of it. This is a quirky problem to describe. But it's real, it's new, and it's pretty unsettling on the road. So that's my challenge.
My best description yet is in the original post. Hopefully someone here can help me point the dealer in the direction of what it could be..
Thanks Sling...,
Dave
