Transmission flush V70-XC70 1998

I purchased a used 1998 V70 T5 from a Volvo dealer in Burlingame CA with 38K mi. in 2001. This week I took it for the 60k service and the dealer claimed that the transmission oil and the power steering oil was dirty and that the thermostat was sticking. I know that the Volvo does not include transmission oil change for the life of the transmission. Was this a trick of the dealer or maybe I bought a lemon? Please send me some advise or whom to contact, thanks.
