Hi all,
I bought this car early October 2016 (outside ebay).
We have contract/ paperwork in order.
After I had paid, the seller wanted more money (additional work I hadnt order, etc). I refused to pay this.
Not possible to discuss with this man.
Then he listed the car up on ebay.
I noticed ebay, but they wouldnt do anything.

Fwiw. I contacted the seller on eBay and hassled him re this, he replied
" This person is a scammer. sorry about that.I own this car.it is a rare car and he is mad because he can not get it shipped.and did not pay for it.any amount.my lawyer will be calling him TODAY.this is a LOT DRIVER so he could not get the proper shipper to come get it.so I relisted it.he is now blocked and reported to EBAY.He ended MY SALE. Kind Regards David."
So that is his side of the story.....reads well, but I don't see why a scammer would bother posting on brick board about his "scam". If you need a screen shot whatever contact me.

Thanks for following up, Patrick.
Yes, thats sounds like him, for sure. And its not true, of course.
I have the agreements, bank transfer and communication if anyone interested.
And Im not blocked from ebay. Here is my profile:

My main point posting this was to warn others not go into the trap I did.

I'm late to this party but if you do indeed have verifiable proof that you sent this person money for a car then perhaps maybe you should make call to NY division of the FBI. Or call the Attorney General's office of the state of NY and file a complaint for fraud.

Used car dealer running for office --- moving from one of the least trusted/respected professions on the planet into the MOST least liked/trusted profession (politician). You can't write this stuff this good.
Good luck pursuing your claim.

Short update last two days, since I posted this warning here and other places:
ebay:
Got a new message from ebay that they are following up my request. Not sure what that means.
Seller:
Angry at me since several people seems to have used the "Report Item" function on the ad.
Would report me to police. Not sure for what.
I said, good, would be happy to talk to them.
Since this didnt scare me, he said he had contacts in FBI :-)
Small Claims:
Have checked it out, cost only $20 but I or a representative needs to be present. Have contacted some lawyers in the area, but minimum charges seems to start at $500.
TV show:
Have sent a tip to this show someone here suggested, not heard back.

This car was just on ebay again last week. I sent a message to the seller asking when I could see the car but only got an answer back the day the auction was ending and was told the car was in Peekskill, not Tarrytown.
He claimed he replied sooner and blamed it on ebay messages. I didn't get a good feeling about it and decided not to pursue it any further.
I would also try reaching him at Big Dee Auto. Although this has nothing to do with their business maybe a call to the GM might get a response from Dave.
If some snake took that much money from me I would keep the pressure on every way I could.

Thanks, interesting to hear about your experience contacting him.

Hi er120799,
FYI. He has 100% star rating. Did you rate him?
http://pages.ebay.com/help/sell/reserve.html
|
|
-
|
Surprise! Ebay gave him 100%, but he only got good ratings for parts. He also sold a MB CL and that person gave him a negative rating. As a seller, he should be at less than 90%.
Take him to small claims court, now! $1800 may be trivial to some, considering the car should be worth around $4K, if you can trust his description.
From the pictures, the car spent a considerable time in Vermont gathering salt and rust while not being garaged. The interior looks nice, but the front seat material is different from the rear seat (which should be original). The car will need a complete respray.
BTW, Volvos don't have 'matching numbers'.

I bought the car outside ebay, so I'm not able to rate him.
He has 10 feedbacks as seller, 9 positive and 1 negative. All more than a year ago.

OK. I didn't read your post correctly. Did you get your money back at least?
|
|

No, I didnt.
Paid $1800 incl transport to port (for shipping to Europe).
After I paid, he failed to deliver to port and wanted $1100 extra.

Hi er 120799,
Well, you now have a card to use against him. He's running for the local office. Isn't technology wonderful?
1. You can sue him as Eric suggested.
2. Make calls to his opponent.
3. Call Nina & tell your story. He will be famous if the channel7 decides to take your case.

Cool! I like :-)
Not that I dont survive without these $1800, its maybe more irritating than the (potential) loss.
I will follow up on what you suggested. Thanks!
|
|

That's a lot of money. Give Dave a call one last time and tell him things will get really ugly if he doesn't pay. Give him some hints.
Everyone pays when Nina and her video man go after. Give her the complete and clear story so she can help you. You can video tape your story and upload.
Best of luck.

Of course, I could call him once more. Not sure that would help much. To me the last calls he sounded as he used some kind of drugs, but that just my impression.
Have contacted 2 lawyers in this county and also filled in the form to this TV show. Will keep you posted if this leads to anything.

The Spano family has a lot of people in Westchester NY politics. Town, County and Legislature level. Might be why local TV folks are steering clear of it.

Even more reason for this complaint to get a public airing IMO.

Yes, good point.
Seems to be some issues though ...

I am new to volvo and this forum. I needed a motor for my 240 and say him on ebay. Didn't see warning until damage was done. I will help anyone else in my shoes and feel free to contact me. Paid 1800 outside ebay as to his suggestions. Called police and sheriff as well as all banks involved. Going to pursue this till the end. Used my dead fathers life insurance to pay for motor 1800 and have nothing to show for it.stay away before it's too late

I can't help with your "case" but I can possibly help you get your car back on the road at as reasonable price. I have three 240's for parts -- one 1990 and two 1989's - all with good motors. I couldn't tell where you are located as your profile shows you to live in that infamous Autaugaville, AL - but if you actually live in the NY Metro area maybe we can get together. I want $400 for a motor and transmission (auto) if I yank it out. If you do the work -- $200. I have all the tools needed here except for a hoist--can rent one locally - or I can borrow one requiring a 35 minute drive each way. I am located on Long Island and may be able to help with transport. - Dave

Thanks for this. Yes, its me posting this warning both here, on Facebook and on Swedespeed. I have already the links to his Facebook and LinkedIn pages, but didnt post this.
Dont be shamed. I have only positive experiences meeting and dealing with Americans through 10-15 years. I guess there are a few bad apples in all societies.

Contact ebay and tell them this seller is trying to sell a car you have already paid for. if you used PayPal to make payment file a complaint with them.

Now back on ebay in a new listing after not making the reserve. Buy-it-now: $1800.

Hello,
If you want to recoup some of loss, don't waste your time with the local police as they almost always too busy dealing with violent crime to do much about civil/property crimes.
Even if you live outside the US you, can sue him in Small Claims court.
You might even wind up on a televised court show if you contact 1 of them.
