Evaporator on 96 850 GLT wagon 850 1996

OK, in my previous post a couple of months ago:

I mentioned that I had taken my 850 GLT to a mechanic due to the lack of cold air and that he had told me that the preostats were bad and replaced them... Everyone out here said that, that diagnosis was rediculous, and that the mechanic knew nothing about Volvo's.

What I failed to mention was that the mechanic I had taken the car to was the DEALERSHIP my wife had bought the car from (Stillman Volvo, West Chester PA.) and that the 'preostats' diagnosis was three months after she had purchased the car, and while it was still under warranty. They recharged it and sent her on her way.

The next spring, when she had no air again, and her warranty had expired, she took the car back, and guess what they said the problem was? Yup, the same thing all of you folks guessed the first time out. They told her that the Evap had gone bad, and that she would have to give them $1500 to replace it.

After getting all the information and timeline together, I sent a message via US Mail addressed to the service manager at stillman, in which I laid out the problem, the initial diagnosis, and the latter. I told them that it was probably an honest mistake (they happen) but that I expected them to help me resolve the problem before I had to write directly to Volvo. Now, I expected to get some lame reply on how they'd like to help but can't, or something like that, but I got NTHING. No reply whatsoever. Is this typical Volvo service? Any advice on a possible resolution?

I saw one of Stillman's folks out here responding to some questions, I'd love to hear what he has to say...

    Failing that, sic a Philly Lawyer on them. It may not take any more than a phone call.

    (If they KNEW about the problem when the warranty was in force, and failed to trace the leak to the evaporator, they should fix it. Free.)

      The catch words there is "If they KNEW" which is impossible to prove in a courtroom IMO.

      It'll also cost more than $1500 to try sueing that dealership, trying to prove that they knew of a more serious problem and lying.

        Yeah, but it'll cost the dealer more than $1500 to defend against the lawsuit, even if they win it. (My hungry Philadelphia lawyer is cheaper than their tony, main line Ivy League law firm.)

    Hey Mick,

    If the retailer does not respond to your complaints contact Volvo Consumer Affairs. The number is on the net or in your owner's manual. They KNOW about this problem with evap's and generally will help out. It works this way:
    If you have had the car regulary serviced at the dealer great. If the car or owner has been a pain in there side( Volvo or the dealer) - not good. Consumer Affairs will usually pay one third/ you pay one third/ and the dealer pays one third. It's about you best option. I work for a retailer so I know what I'm talking about.

      but... 850 1996

      We are talking about an older '96 car (now almost 7 yrs old) that's been sold as "used". Volvo might have helped if it were a car marginally out of warranty but a '96 850 is hardly close to that and I highly doubt they'll do anything here.
